Terms and Conditions

By purchasing, enrolling in, or accessing The Energetic Advantage (TEA) (the “Program”), you agree to these Terms and Conditions (the “Terms”). If you do not agree, do not purchase or access the Program.

1. Definitions

  • Company / we / us / our: Nine Lemons Feng Shui (Stephanie McConachy).

  • You / your / participant: the purchaser and any person accessing the Program under your purchase.

  • Program: The Energetic Advantage, including live calls, recordings, resources, community spaces (including Telegram), templates, frameworks, PDFs, audios, and any related materials.

  • Third-party platforms: platforms used to deliver the Program (for example Zoom, Telegram, payment processors, course platforms).

2. Eligibility and Account Responsibility

You confirm you are at least 18 years old and legally able to enter into these Terms. You are responsible for ensuring your devices, internet, and software allow access to the Program.

If access requires login credentials, you must keep them confidential and you must not share access with others.

3. Program Inclusions, Delivery, and Changes

3.1 Delivery format

The Program is delivered as a live group experience with supporting resources and a community space (for example Telegram). The Program includes live sessions scheduled across the Program period, and may include a bonus integration or Q&A call after the Program.

3.2 Scheduling and changes

Dates and times may change due to illness, technology issues, or operational needs. If we reschedule, we will provide reasonable notice where possible. We may adjust the content, sequencing, frameworks, or delivery method to improve outcomes or for operational reasons, provided we do not materially reduce the overall value of the Program.

3.3 Replays and access period

Recordings and replays (if provided) are made available for participant convenience and are not guaranteed in all circumstances (for example due to platform failure). Access to Program materials is provided for 7 years from the Program start date unless otherwise stated at purchase.

Telegram or community access (if included) is available for for the 90 day program plus an additional 90 day integration unless otherwise stated.

3.4 Participant responsibility

You are responsible for your participation, implementation, and results. The Program is not a substitute for professional advice or services.

4. Fees, Payment Plans, and Failed Payments

4.1 Fees

Program fees are shown at checkout in the currency specified (for example USD). You authorise us (or our payment processor) to charge the payment method you provide.

4.2 Payment plans

If you select a payment plan:

  • You agree to pay all instalments in full and on time.

  • Payment plan obligations continue even if you do not attend live sessions, do not complete the Program, or stop participating.

4.3 Failed payments

If a payment fails or is reversed (including chargebacks), we may suspend or remove access to the Program, recordings, resources, and community spaces until your account is brought current. We are not responsible for any loss resulting from paused access due to failed payments.

5. Refunds and Cooling-Off

5.1 7-day cooling-off

We offer a 7-day cooling-off period from the date of purchase. If you request cancellation in writing within 7 days, you will receive a full refund.

5.2 No refunds after cooling-off

Refund requests after the 7-day period are not eligible for a refund, except where required by Australian Consumer Law.

5.3 How to request

Refund requests must be submitted in writing to: support@ninelemonsfengshui.com with your full name, purchase email, and the Program name.

5.4 Australian Consumer Law

Nothing in these Terms excludes, restricts, or modifies rights you have under the Australian Consumer Law that cannot be excluded.

6. No Guarantees, Results Disclaimer

The Program is designed to support environment alignment, clarity, and implementation through Feng Shui-based frameworks and strategic guidance. However:

  • We do not guarantee results of any kind, including financial, business, visibility, career, relationship, health, wellbeing, or personal outcomes.

  • Results vary based on many factors outside our control including your choices, circumstances, effort, timing, and environment.

  • Any examples, case studies, testimonials, or outcomes referenced are illustrative only and are not a promise or prediction of your results.

7. Not Medical, Legal, Financial, or Therapeutic Advice

The Program is educational and informational. It is not medical, psychological, legal, tax, or financial advice, and it does not replace professional services.

You agree that:

  • You are responsible for your own decisions, actions, and outcomes.

  • If you require medical, psychological, legal, tax, or financial advice, you will seek support from an appropriately qualified professional.

  • You will use your judgement and act within your personal and professional circumstances.

8. Intellectual Property and Licence

8.1 Ownership

All Program materials are owned by us or licensed to us and are protected by copyright and other intellectual property laws.

8.2 Limited licence

You are granted a limited, non-exclusive, non-transferable licence to access and use the materials for your personal use only during the access period.

8.3 Prohibited uses

You must not:

  • copy, reproduce, resell, sublicense, distribute, publish, or share Program materials (in whole or part)

  • use Program materials to create a competing product, training, or service

  • share login access or provide access to anyone else

  • upload materials to shared drives, public forums, or AI training datasets

9. Recording, Screenshots, and Confidential Materials

To protect participants and the integrity of the Program:

  • Recording live sessions, community discussions, or any Program content is prohibited unless we explicitly permit it in writing.

  • You must not share screenshots, transcripts, or reproductions of community discussions, participant posts, or Program materials.

We may record live sessions for replay purposes. By participating, you consent to being recorded in a group setting. If you do not want to appear on replay, you must keep your camera off and avoid speaking on the recording, or follow any alternative process we provide (for example submitting questions via chat).

10. Community Guidelines, Conduct, and Safety

You agree to:

  • act respectfully and professionally

  • avoid disruptive behaviour

  • avoid harassment, bullying, discrimination, or abusive language

  • refrain from defamatory statements or malicious conduct toward us, our team, or other participants

  • not provide harmful or misleading claims about the Program or other participants

We can remove content, restrict participation, or revoke access if you breach these standards.

11. Confidentiality

You agree that personal stories, layouts, case studies, and discussions shared by participants (or by us about participants) are confidential.

You must not disclose or misuse sensitive information shared in the Program or community spaces. This confidentiality obligation continues after the Program ends.

12. Revoking Access

We may restrict, suspend, or permanently revoke access to the Program, recordings, resources, and community spaces without refund if you:

  • breach these Terms

  • share or misuse Program materials

  • engage in harmful, disruptive, or unsafe conduct

  • breach confidentiality

  • fail to pay amounts due (including payment plans)

13. Third-Party Platforms and Service Interruptions

The Program may be delivered via third-party platforms. We are not responsible for outages, platform changes, service interruptions, or your inability to access third-party services. If a platform becomes unavailable, we may move delivery to an alternative platform.

14. Privacy

We handle personal information in accordance with our Privacy Policy.

You acknowledge that participation in community spaces may involve sharing information with other participants. You are responsible for what you choose to share.

15. Testimonials and Marketing

If you provide feedback, comments, or testimonials (written, audio, or video), you grant us permission to use them for marketing, unless you explicitly revoke consent in writing.

If you do not want your name or identifying details used, notify us in writing and we will use reasonable efforts to de-identify content.

16. Limitation of Liability

To the maximum extent permitted by law:

  • We are not liable for any indirect or consequential loss, including loss of profit, revenue, data, or opportunity.

  • Our total liability for any claim related to the Program is limited to the amount you paid for the Program.

Nothing in these Terms limits liability where it cannot be limited under Australian Consumer Law.

17. Indemnity

You agree to indemnify us against claims, damages, losses, or expenses arising from your breach of these Terms, your misuse of Program materials, or your unlawful or harmful conduct in the Program or community spaces.

18. Dispute Resolution

If a dispute arises, you agree to contact us first in writing at support@ninelemonsfengshui.com and attempt to resolve it in good faith. If the dispute cannot be resolved within a reasonable period, either party may pursue available legal remedies.

19. Governing Law and Jurisdiction

These Terms are governed by the laws of South Australia. You submit to the exclusive jurisdiction of the courts of that state/territory.

20. Miscellaneous

  • Severability: If any clause is unenforceable, the remaining clauses continue in effect.

  • No waiver: Failure to enforce a clause does not waive our right to enforce it later.

  • Entire agreement: These Terms form the entire agreement between you and us regarding the Program.

  • Assignment: We may assign or transfer our rights and obligations under these Terms as part of business operations or restructuring
