Nine Lemons Feng Shui Terms & Conditions

These Terms and Conditions (“Terms”) apply when you purchase, enrol in, register for or access a programme, membership, course, workshop, masterclass, consultation, digital product, resource or other service offered by Nine Lemons Feng Shui.
By purchasing, enrolling in, registering for or accessing an applicable Program or Service, you agree to these Terms.
1. Definitions
For the purposes of these Terms:
Company / we / us / our: Nine Lemons Feng Shui (Stephanie McConachy).
You / your / participant: the person purchasing, registering for or accessing a Program or Service.
Program or Service: any programme, membership, course, workshop, masterclass, event, consultation, digital product, resource or other service offered by Nine Lemons Feng Shui, whether paid or free, as described on the relevant sales page, registration page or checkout.
Third-party platforms: external services we use to operate or deliver our Programs and Services, which may include video conferencing, community, course delivery, payment, email, SMS and customer relationship management platforms.
2. Eligibility and Account Responsibility
You confirm that you are at least 18 years old and legally able to enter into these Terms.
You are responsible for ensuring that your devices, internet connection and software allow you to access the relevant Program or Service.
Where access requires login credentials, those credentials are for your personal use. You must keep them confidential and must not share access with another person unless we expressly permit this in writing.
3. Program and Service Inclusions
The format, inclusions, duration, access period and delivery method of each Program or Service will be described on the relevant sales page, registration page, checkout or other information provided to you at the time of purchase or registration.
Depending on the offer, a Program or Service may include live sessions, recorded content, individual consulting, digital resources, templates, PDFs, audio content, community access or other forms of delivery.
Not every Program or Service includes every type of delivery or access described in these Terms.
Where the specific terms of an offer differ from these general Terms, the specific terms clearly disclosed to you on the relevant sales page or checkout will apply to that offer to the extent of the inconsistency.
4. Scheduling, Delivery and Changes
Dates, times and delivery arrangements may occasionally change due to illness, technology issues, availability or operational requirements.
Where reasonably possible, we will provide notice of material scheduling changes.
We may make reasonable changes to the content, sequencing, frameworks, resources, platforms or delivery methods of a Program or Service where necessary to improve delivery or for operational reasons, provided those changes do not materially reduce the overall value of the Program or Service you purchased.
Recordings or replays may be provided for certain Programs or Services. Unless expressly guaranteed as part of an offer, recordings are provided for convenience and cannot be guaranteed in circumstances outside our reasonable control, such as technical or platform failure.
5. Access Periods
The access period for a Program or Service will be stated on the relevant sales page, registration page or checkout where applicable.
Where a specific access period is not stated, we will provide access for a reasonable period having regard to the nature of the Program or Service.
Access to communities, group chats, live support, individual support or other time-limited elements is available only for the period specified for the relevant offer.
Access may also end where your membership or subscription is cancelled, your payment obligations are not met, or your access is revoked in accordance with these Terms.
6. Fees and Payments
Prices are displayed in the currency specified on the relevant sales page or checkout.
By purchasing a paid Program or Service, you authorise Nine Lemons Feng Shui and its payment providers to charge the payment method you provide for the amount and payment schedule disclosed at checkout.
You are responsible for ensuring that your payment and billing information remains accurate and up to date.
7. Payment Plans
If you select a payment plan, you are committing to pay the full series of instalments disclosed to you at checkout.
A payment plan is a method of paying the total purchase price over time and is not a month-to-month subscription unless expressly stated otherwise.
Your obligation to complete a payment plan continues if you stop participating, do not attend live sessions, do not use the materials or otherwise choose not to complete the Program or Service, subject to any rights you have under Australian Consumer Law or another applicable law that cannot lawfully be excluded.
8. Membership Subscriptions
Where you join a Nine Lemons Feng Shui membership, your membership is a recurring subscription.
Unless otherwise expressly stated at the time you join, membership has a minimum commitment of three months.
By joining, you authorise us or our payment provider to charge the membership fee at the billing interval disclosed at checkout for the minimum three-month commitment.
You may cancel your membership at any time. If you cancel during your initial three-month minimum commitment, you remain responsible for any membership payments due for the remainder of that minimum commitment. Your membership will then end at the conclusion of the three-month minimum period and will not renew.
After you have completed the minimum three-month commitment, your membership will continue to renew at the applicable billing interval until cancelled. You can cancel before your next renewal to prevent the next recurring charge.
Cancellation does not retrospectively refund membership fees already paid and does not remove payment obligations arising during the minimum commitment period, except where required by law.
Any changes to membership pricing will be communicated in advance and will apply in accordance with the terms communicated to you at that time.
9. Failed and Overdue Payments
If a scheduled payment fails, is declined, reversed or otherwise remains unpaid, we may:
attempt to process the payment again;
contact you to request updated payment information or arrange payment;
temporarily suspend access to the relevant Program, Service, membership, recordings, resources, community or support while payment remains outstanding; and
where payment remains unresolved, cancel or revoke access.
We reserve the right to recover amounts properly due under an agreed payment plan or minimum membership commitment.
Suspension or cancellation of access due to non-payment does not automatically cancel amounts already due under your agreed payment obligations.
Nothing in this section limits rights available to you under Australian Consumer Law or other applicable laws that cannot lawfully be excluded.
10. Cancellations, Refunds and Cooling-Off
10.1 Paid Programs and Services
Where a specific refund or cancellation policy is stated on the relevant sales page or checkout, that policy applies to the purchase.
Unless otherwise stated for a particular offer, we provide a 7-day cooling-off period from the date of purchase for eligible Programs and Services. A cancellation request made in writing within this period will receive a refund of amounts paid, subject to any limitations clearly disclosed at the time of purchase and applicable law.
After the applicable cooling-off or refund period, purchases are non-refundable except where required by law.
10.2 Memberships
The three-month minimum membership commitment applies unless a different commitment is expressly disclosed when you join or you have a statutory right to cancel.
If you cancel during the minimum commitment period, your membership will end after the minimum three-month period and you remain responsible for payments due during that period.
Once the minimum commitment has been completed, you may cancel before your next renewal to prevent the next recurring membership charge.
10.3 Cancellation Requests
Where cancellation cannot be completed directly through your account, cancellation or refund requests should be sent to:

Please include your full name, the email address used for purchase and the name of the relevant Program or Service.
10.4 Australian Consumer Law
Nothing in these Terms excludes, restricts or modifies any guarantee, right or remedy available to you under the Australian Consumer Law that cannot lawfully be excluded, restricted or modified.
11. Free Masterclasses, Events and Resources
We may offer free masterclasses, workshops, events, guides, resources and other content.
Registration for a free Program or Service does not create an obligation to purchase a paid product or service.
Any specific conditions associated with a free Program or Service will be disclosed on the relevant registration page.
Free content is provided for educational and informational purposes and is subject to the relevant provisions of these Terms, including intellectual property, disclaimers and appropriate conduct.
12. Participant Responsibility and No Guarantees
Our Programs and Services are designed to provide Feng Shui education, environmental guidance, strategic frameworks and related support.
Your results depend on many factors outside our control, including your individual circumstances, decisions, implementation, environment and timing.
We do not guarantee any particular financial, business, visibility, career, relationship, health, wellbeing, personal or other outcome.
Examples, testimonials, case studies and participant outcomes are illustrative only and do not constitute a promise, guarantee or prediction of your results.
You remain responsible for your own decisions, implementation and outcomes.
13. Not Medical, Psychological, Legal, Financial or Other Professional Advice
Our Programs and Services are educational and informational in nature.
They are not a substitute for medical, psychological, therapeutic, legal, tax, financial, structural, architectural, electrical or other appropriately qualified professional advice or services.
Where professional advice is appropriate to your circumstances, you are responsible for obtaining advice from a suitably qualified professional.
You are responsible for determining whether and how to implement any information or recommendations provided by Nine Lemons Feng Shui.
14. Intellectual Property
All Program and Service materials created by Nine Lemons Feng Shui, including frameworks, presentations, videos, recordings, written materials, PDFs, templates, audio, graphics and other resources, are owned by or licensed to Nine Lemons Feng Shui and are protected by applicable intellectual property laws.
Unless otherwise expressly stated, you receive a limited, personal, non-exclusive, non-transferable licence to access and use materials for your own personal use.
You must not, without our written permission:
copy, reproduce, distribute, publish or share our materials;
resell or sublicense our materials;
provide another person with access to paid materials;
use our materials to create a competing product, programme, training or service;
upload our materials to public forums, shared repositories or AI training datasets; or
remove branding, copyright notices or other proprietary information.
15. Recording, Screenshots and Participant Content
You must not record live sessions, community discussions or Program content unless we expressly permit you to do so.
You must not publish or distribute screenshots, recordings, transcripts or reproductions containing confidential Program content or information shared by other participants.
We may record live sessions for replay, educational or internal purposes.
Where a group session is being recorded, we will take reasonable steps to make participants aware. If you do not wish to appear in a recording, you should keep your camera off and avoid speaking while recording is taking place, or use an alternative method provided for participation where available.
16. Community Conduct
Where a Program or Service includes access to a community, group chat or other participant space, you agree to behave respectfully and professionally.
You must not engage in harassment, bullying, discrimination, abusive conduct, deliberate disruption, unlawful activity or conduct that reasonably threatens the safety, privacy or participation of others.
We may moderate content and restrict or revoke participation where these standards are breached.
17. Confidentiality
Personal stories, home information, layouts, case studies, business information and other confidential information shared by participants in a Program or community must be treated respectfully and confidentially.
You must not disclose, reproduce or misuse confidential information shared by another participant.
These confidentiality obligations continue after your participation ends.
18. Suspension or Revocation of Access
We may reasonably restrict, suspend or revoke access to a Program or Service where you:
materially breach these Terms;
share or misuse protected Program materials;
engage in harmful, abusive or seriously disruptive conduct;
materially breach another participant's confidentiality or privacy;
engage in unlawful conduct in connection with the Program or Service; or
fail to meet payment obligations.
Where appropriate, we may first contact you and provide a reasonable opportunity to address the issue.
Serious breaches may result in immediate suspension or revocation where reasonably necessary to protect Nine Lemons Feng Shui, our intellectual property, our team or other participants.
Any refund entitlement following suspension or revocation remains subject to applicable consumer law.
19. Third-Party Platforms
We use third-party platforms and service providers to operate and deliver aspects of our business and Programs and Services.
We are not responsible for outages, service interruptions or platform changes outside our reasonable control.
If a platform becomes unavailable, we may move delivery to a reasonably suitable alternative.
20. Privacy
We handle personal information in accordance with the Nine Lemons Feng Shui Privacy Policy.
Where you participate in a community, group session or other shared environment, information you voluntarily disclose may be visible to other participants. You are responsible for considering what personal information you choose to share in those spaces.
21. Mobile Messaging Terms
If you opt in to receive SMS or text messages from Nine Lemons Feng Shui, you consent to receive recurring text messages from us at the mobile number you provide.
Messages may include information, confirmations and reminders relating to content, masterclasses, events, Programs or Services you have requested, as well as promotional or marketing messages where you have opted in to receive them.
You may opt in by submitting your mobile number through a Nine Lemons Feng Shui website, registration form, checkout page or other form that clearly states that you are consenting to receive text messages.
Message frequency varies depending on the content, event, Program or Service you have requested and your interactions with Nine Lemons Feng Shui.
Message and data rates may apply.
You can opt out of SMS communications at any time by replying STOP to any message. After opting out, you may receive a confirmation message and will no longer receive applicable SMS marketing communications unless you opt in again.

Consent to receive marketing text messages is not a condition of purchasing any goods or services.
Mobile phone numbers and SMS opt-in or consent data will not be sold or shared with third parties or affiliates for their own marketing or promotional purposes.
We may use service providers to facilitate delivery of our SMS communications. Those providers may process mobile information solely as necessary to provide services to Nine Lemons Feng Shui and not for their own marketing or promotional purposes.
Our collection and use of personal information in connection with SMS is also governed by our Privacy Policy.
22. Testimonials and Feedback
If you voluntarily provide feedback, comments, reviews, messages or other statements about your experience with Nine Lemons Feng Shui, we may use that feedback for testimonial, educational or marketing purposes.
Unless you have given us permission to identify you, we will use your feedback in a non-identifiable or limited-identification format. This may include using your first name, initials, a general description or anonymised wording that does not reasonably identify you.
We will seek your permission before using identifying information such as your full name, photograph, business name, social media handle or other information that would reasonably identify you in connection with a testimonial.
We may make minor edits to feedback for length, clarity, spelling or formatting, provided we do not materially change its meaning.
If you ask us to stop using testimonial material attributed to you, we will take reasonable steps to cease future use, subject to materials already produced or published.
23. Limitation of Liability
To the maximum extent permitted by law, Nine Lemons Feng Shui is not liable for indirect or consequential loss arising from your participation in or use of a Program or Service.
To the extent permitted by law, our aggregate liability arising from a paid Program or Service will not exceed the amount you paid for the relevant Program or Service giving rise to the claim.
Nothing in these Terms excludes or limits liability, guarantees, rights or remedies that cannot lawfully be excluded or limited.
24. Indemnity
To the extent permitted by law, you agree to indemnify Nine Lemons Feng Shui against losses, claims or expenses arising directly from your unlawful conduct, material breach of these Terms or unauthorised misuse of our intellectual property.
This provision does not apply to the extent a loss was caused or contributed to by Nine Lemons Feng Shui or where such an indemnity cannot lawfully apply.
25. Dispute Resolution
If a dispute arises, we ask that you contact us first at:

We will attempt to resolve the matter in good faith.
Nothing in this section prevents either party from exercising rights or remedies available under applicable law.
26. Governing Law and Jurisdiction
These Terms are governed by the laws of South Australia, Australia.
Subject to any rights you may have under applicable consumer law, the parties submit to the jurisdiction of the courts of South Australia.
27. Changes to These Terms
We may update these Terms from time to time to reflect changes to our Programs, Services, business practices, technology or legal requirements.
The version that applies to a purchase will generally be the version made available at the time of purchase, except where a change is required by law or expressly agreed with you.
For ongoing memberships or services, material changes that affect your rights or obligations will be communicated where reasonably required.
28. Miscellaneous
Severability: If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions continue to apply.
No waiver: A failure to enforce a provision does not waive our right to enforce it later.
Assignment: We may assign or transfer our rights and obligations as part of a legitimate business restructure, sale or transfer, subject to applicable law.
Entire agreement: These Terms, together with any specific terms disclosed on the relevant sales page or checkout, form the agreement between you and Nine Lemons Feng Shui in relation to the relevant Program or Service.
